국민의힘 진종오 국회의원(비례대표, 문체위)이 26일 국회의원회관 제2세미나실에서  개최한 조례 전문 세미나가 각계 전문가들의 열띤 참여 속에 성황리에 마무리됐다.

국민의힘 진종오 의원과 더불어민주당 모경종 의원, 한국조례학회가 공동 주최한 이번 세미나는 국내 최초 조례 전문 학술단체인 한국조례학회가 국회에서 개최한 첫 공식행사로 특별한 의미를 갖는다. 

지방자치제도 시행 30주년을 맞아 그간의 조례 성과를 돌아보고 향후 제도 개선 방안을 모색하기 위해 마련된 자리였다.

세미나에서는 지방자치 30주년과 조례의 역사, 조례의 분야별 이슈와 쟁점, 일상을 바꾼 대표적 조례 사례, 조례가 나아가야 할 방향 등 네 가지 주제로 정부 부처 및 연구기관, 학계, 지방의회 관계자들이 참여해 심도 있는 논의를 펼쳤다.

이날 현장에는 더불어민주당 이재관 의원, 박정현 의원, 김현중 한국산업안전보건공단 이사장, 김남석 한국조례학회 이사장, 이재영 전 행정안전부 차관, 조명우 전 인천광역시 부시장, 도윤호 시도지사협의회 사무차장, 조재구 대한민국시장군수구청장협의회 회장, 서한순 전 인사혁신처 인재채용국장, 이경제 한의원장 등이 내빈으로 참석했다.

첫 번째 발제자인 이인재 한국조례학회 상임이사(전 파주시장)는 "조례는 크게 두 가지 쟁점이 있다"며 "첫 번째는 현행 법령 체계상의 지위를 어떻게 할 것인가이고, 두 번째는 주민이 어떻게 많이 참여하게 할 것인가"라고 핵심 쟁점을 제시했다. 

그는 조례의 역사와 현행 제도의 문제점, 개선방향, 그리고 앞으로 나아갈 조례의 청사진을 구체적으로 제시했다.

두 번째 발제를 맡은 이상호 한국조례신문 편집인(전 경향신문 부국장)은 "지방의회가 어쩌면 국가나 정부보다 더 국가의 변화를 일으킬 수 있다"며 "조례는 작지만 강한 법"이라고 강조했다. 

그는 행정정보공개, 무상급식, 치매환자 지원, 생활체육진흥 등 대한민국을 실질적으로 변화시킨 대표적인 조례 사례들을 소개하며 조례의 실질적 효과를 입증했다.

종합토론에는  ▲이준식 행정안전부 자치분권과장, ▲유상조 전 행정안전위원회 수석전문위원, ▲윤태웅 대한민국시도지사협의회 선임연구위원, ▲이상범 대한민국시장군수구청장협의회 정책연구실장, ▲차현숙 한국법제연구원 혁신법제본부장, ▲최병호 경기도 교육청 학교안전공제회 사무처장, ▲이준호 부산광역시의원, ▲박강산 서울특별시의원, ▲정보현 인천광역시 연수구의원 등이 참석해 열띤 토론을 펼쳤다. 

특히 조례가 양적 경쟁 중심으로 흐르며 '택갈이식 입법'이 확산되고 있다는 우려, 정치·이해관계 유착으로 인한 청탁성 조례 문제, 주민 조례발안 제도의 실효성 제고 필요성 등이 주요 쟁점으로 지적됐다.

전문가들은 조례의 질적 향상을 위한 전문 인력 확충, 아카이브 구축 등 구체적이고 현실적인 개선방안들을 제시했다.

진종오 의원은 개회사에서 "지방자치 30년 동안 12만 건이 넘는 조례가 제정되며 주민의 삶을 바꾸고 지역사회를 발전시켜왔다"며 "학교·복지·안전·환경 등 우리의 일상 대부분이 사실상 조례에서 비롯되기에 조례야말로 지방자치의 심장이라 할 수 있다"고 강조했다.

그는 또한 "주민 참여 부족, 자치입법 권한의 한계, 조례 간 충돌 문제 등은 풀어야 할 과제"라며 앞으로의 개선 방향을 제시했다.

이준호 부산시의원을 필두로 고덕희 고양시의원, 이덕수 성남시의원, 손은비 인천중구의원, 육은아 인천남동구의원 등 조례학회 홍보에 참여하고 있는 지방의회 의원들은 조례의 중요성과 전문성을 의정활동에 적극 반영하겠다는 의지를 표명했다. 이들은 지역 주민의 삶의 질 향상과 균형 있는 지역 발전을 이끄는 입법과 행정에 앞장서겠다고 밝혔다.

김태효 대한체육회 성평등위원도 참석해 조례의 중요성에 깊이 공감하며 관련 제도 개선을 위한 협력에 동참할 뜻을 밝혔다.

The seminar on ordinances, hosted by People Power Party Representative Jin Jong-oh (Proportional Representation, Culture, Sports and Tourism Committee) at the National Assembly Members' Hall In the second seminar room on the 26th, concluded successfully with enthusiastic participation from experts from various fields.

Co-hosted by People Power Party Representative Jin Jong-oh, Democratic Party Representative Mo Kyung-jong, and the Korean Society of Ordinance Studies, this seminar held special significance as the first official event held at the National Assembly by the Korean Society of Ordinance Studies, Korea's first academic society specializing in ordinances.

The seminar was designed to commemorate the 30th anniversary of the local autonomy system and to reflect on the achievements of ordinances to date and explore future improvements.

The seminar featured in-depth discussions with representatives from government ministries, research institutes, academia, and local councils on four topics: the 30th anniversary of local autonomy and the history of ordinances, issues and controversies across ordinances, representative examples of ordinances that have transformed our daily lives, and the future direction of ordinances.

Distinguished guests included Democratic Party lawmakers Lee Jae-kwan and Park Jeong-hyeon, Korea Occupational Safety and Health Agency Chairman Kim Hyun-joong, Korean Society of Ordinance Studies Chairman Kim Nam-seok, former Vice Minister of the Ministry of the Interior and Safety Lee Jae-young, former Incheon Metropolitan City Vice Mayor Cho Myung-woo, Deputy Secretary-General Do Yoon-ho, Korea Mayors and County Governors Association Chairman Cho Jae-gu, former Director of the Human Resources Recruitment Bureau at the Ministry of Personnel Management Seo Han-soon, and Lee Gyeong-je, President of Korean Medicine Clinic.

The first presenter, Lee In-jae, Executive Director of the Korean Society of Ordinances (former Mayor of Paju), stated, "Ordinances have two major issues. The first is how to maintain their status within the current legal system, and the second is how to encourage greater participation from residents."

He detailed the history of ordinances, the current system's problems, directions for improvement, and a blueprint for future ordinances.

The second presenter, Lee Sang-ho, Editor-in-Chief of the Korean Ordinance Newspaper (former Deputy Director of the Kyunghyang Shinmun), emphasized, "Local councils may be more capable of influencing national change than the central government," and emphasized, "Ordinances are small but powerful laws."

Key points raised included concerns that ordinances are increasingly focused on quantitative competition, leading to the spread of "pick-your-own-legislation," the problem of political and vested interests colluding in ordinances, and the need to improve the effectiveness of the resident ordinance proposal system.

Experts proposed specific and practical improvement measures, including expanding professional staff and establishing archives to enhance the quality of ordinances.

Local council members who are actively promoting the Society for Ordinance Studies, including Busan City Councilman Lee Jun-ho, Goyang City Councilman Ko Deok-hee, Seongnam City Councilman Lee Deok-soo, Incheon Jung-gu Councilman Son Eun-bi, and Incheon Namdong-gu Councilman Yuk Eun-ah, expressed their commitment to actively incorporating the importance and expertise of ordinances into their legislative activities. They pledged to lead legislation and administration that enhance the quality of life for local residents and promote balanced regional development.

Kim Tae-hyo, a member of the Gender Equality Committee of the Korea Sports Council, also attended, deeply empathizing with the importance of the ordinance and expressing his willingness to cooperate in improving related systems.

This seminar, marking the 30th anniversary of local autonomy, is considered a meaningful opportunity to reexamine the role and importance of the ordinance and explore future directions for development.
