고양시는 17일 ‘고양시 청사 백석동 이전에 따른 경기도 주민감사 청구’ 감사결과 청구내용에 대한 위법사항이 없어 청사이전의 정당성이 확보되었다고 밝혔다.

경기도 감사결과에 따르면 청구인 측의 ‘신청사 이전 관련 시장의 편법행위 및 부당한 업무지시’, ‘백석 업무빌딩의 국토계획법 상 기준 미부합’ 주장은 감사결과 위법사항을 발견하지 못했다. 다만 도는 타당성 조사 추진과정에서 지방재정법 등 위반이 있었다고 지적했다. 

청구인들은 주민감사 청구에서 ① 시청사 이전 업무분장에 대한 의회 승인 편법 이탈, ② 의회승인 절차 무시하라는 부당한 업무지시, ③ 행정절차 중단에 따른 민형사상 책임의 발생, ④ 백석동 업무빌딩의 국토계획법상 「도시·군계획시설의 결정·구조 및 설치 기준에 관한 규칙」 기준 미부합 등을 주장했다. 

그러나 경기도는 감사결과 위와 같은 사무를 처리하는 과정에서 위법·부당한 사항이 발견되지 않았다고 판단했다.

다만, 이번 감사 결과에서 청구인들의 주장 외에 타당성조사와 관련 시설비 항목으로 예산을 편성하지 않았다며  지방재정법 등 위반을 지적했다.

고양시는 이에 대해 “지방자치법 제21조 제9항에 의거 주민감사청구는 감사 청구된 사항에 대해서만 감사하도록 규정되어 있고, 경기도는 지난 5월 시·군의 자치권을 보장하기 위해 자치사무에 대한 감사자료를 요구하지 않기로 한 감사업무혁신안을 발표한 바 있다. 

이어 “경기도 등 타지자체에서도 타당성 조사 수수료를 사무관리비로 편성하여 사업을 추진하고 있는 만큼, 타당성 조사 수수료 경비 집행 비목이 적정함 등의 이유를 들어 재심을 청구할 예정”이라고 밝혔다.

시 관계자는 “청구인들이 주장한 고양시 청사 이전의 위법성은 감사결과 문제없는 것으로 밝혀졌다. 다만 청구사항 외의 타당성 조사는 시의회에 예산상정을 위한 사전 절차로 의회의 예산 심의·의결권을 무시한 것이 결코 아니며, 감사결과에서 지방의회와 협의, 지역 주민들 의사의 충분한 반영을 권고한 만큼 앞으로 적극적인 소통을 통한 시의회 동의와 시민들의 공감과 지지를 바탕으로 청사 이전을 추진하겠다”고 강조했다. 

이어 “타당성 조사와 관련한 지방재정법 등 위반 여부에 대해서는 재심 청구를 통해서 문제없음을 충분히 다툴 수 있을 것”이라고 밝혔다.

시 관계자는 “낮은 재정자립도, 세수감소 등으로 시 재정이 어려운 상황에서 4천억원의 신청사 건립비용을 절감하기 위한 시청사 백석이전을 흔들림 없이 추진하고 원당지역을 더 발전시키기 위한 원당재창조프로젝트도 적극 진행해 나가겠다”고 전했다. [고양=박정호  기자]
